What? He put it in reverse instead of park and exited the car. Very unfortunate, but the car didn’t do anything on it s own. That kind of passive writing always bugs me. To me, it’s s imilar to the “accident” vs “crash” debate.

My vote on the whole accident/crash debate - it doesn’t matter because it’s still sh!tty for the dude and his family. But a good remember to pay extra attention at Jack in the Box.

I’m going to post my comment again.
If you plan on stepping out or really even reaching out of your vehicle, PUT IT IN PARK. Better yet, put in park and set the ebrake, if that becomes habit it could save you from what I suspect happened here. My guess is that he went to put in park and only got it to r, stepped out of vehicle and panicked when it started rolling backwards. I can’t come up with another reason for the car to be in r. If the ebrake was set this wouldn’t have been a life ending mistake.

It seemed like in the late ‘90s/early ‘00s , the media (usually local news) loved doing this with any crash involving an SUV. It was always “an SUV careened” or “an SUV ran over” or “an SUV plowed through”, the driver was a non entity.

Read about this in a different article this morning, and I’m still having trouble wrapping my mind around it. There are just so many things going wrong that I can’t tell how it all started, or how exactly it snowballed into this result.
He pulls up “at an angle”... how? Like where did he even come from? Once you round the corner after placing your order, it’s a straight shot. What’s so hard about that? The angle didn’t even help him, since he still had to open his door to reach for the food. I thought that maybe he had placed it in reverse in an attempt to line the car up better, but this article seems to clarify that it was a mis-shift that happened while he was opening the door. And it was while he was doing this that he put his foot on the accelerator. There’s just so much stupid happening here that I can’t even.

This is the scene :
The only tree I see is the one along the street. The article did say he pulled up to the window at an angle, but you’d have to be at a pretty extreme angle to get pinned against that tree.

It’s way off to the side, unless they’re talking about a different tree that was further away from the building. ( map here ) I still don’t understand how he ended up there.

“The car lurched backward” is similar to the ubiquitous “the gun went off.”
These are machines that don’t act on their own, and 99.99% of the time they kill people due to user error (or intent)

Seems that way. The street view is from 2017 , so I guess they could have planted a bunch of dangerous trees in the past year , but it seems pretty unlikely.

I’m guessing he must have jerked the steering wheel or something as the car backed up. And even then, what are the F’n chances that the car would just happen to hit the tree, instead of rolling into the street?

I cannot see any conceivable way that this would happen to someone in full mental capacity. I strongly suspect substance abuse related impairment.
Here’s what I’m coming against in trying to work through this. So let’s assume that someone or something was in the way as that’s the only reason you pull up to a drive through at an angle unless you’re impaired.
As you pull up to the window you must apply the brakes to stop. You put it in reverse thinking you put it in park.
Now. You either
1. Come off the brakes before you get out and the car starts rolling backwards and you just either stop it or you hit the gas instead of the brakes and hit the tree alive and inside the car , or
2. You begin exiting the vehicle with your foot still on the brake (Iv e done this while in drive), you can open the door and get one foot out. As soon as the other foot come off the brake you’ll be rolling backwards though. I can’t see how it would be possible to be coming off the brakes while my body is outside the vehicle.
